Abstract
These Regulations amend in respect of Scotland the Conservation (Natural Habitats, &c.) Regulations 1994 for purposes of carrying into effect provisions of the Council Directive 92/34/EEC on the conservation of natural habitats and of wild fauna and flora and, in particular, Directive 2009/147/EC of the European Parliament and of the Council on the conservation of wild birds. They, among other things, insert new regulations to the effect that the Scottish Ministers must classify as a special protection area all sites up to territorial sea limit adjacent to Scotland that require to be classified pursuant to Articles 4(1) and 4(2) of the Wild Birds Directive and require a proposed special protection area to be notified to Scottish Natural Heritage. They also enable the Scottish Ministers to delegate the exercise of some of their functions.
