Abstract
The present Act contains provisions regarding energy production and security and the regulation of the energy market. This includes provisions for the licensing of carbon dioxide transport and storage (Part 1) encompassing grant and conditions of licences, transfer and termination of licences, functions of the economic regulator and the CMA related to monitoring, competition. Part 2 regulates commercial arrangements for carbon capture and storage, decommissioning of carbon storage installation, licence, and other matters related to information and samples. The Secretary of State may designate a statement as the strategy and policy statement for the purposes of this Part (“the CCUS strategy and policy statement”) if the requirements set out in section 102 are satisfied (consultation and laying requirements). (2)The CCUS strategy and policy statement is a statement prepared by the Secretary of State that sets out— (a)the strategic priorities, and other main considerations, of His Majesty’s government in formulating its carbon dioxide capture, usage and storage policy for the United Kingdom (“strategic priorities”), (b)the particular outcomes to be achieved as a result of the implementation of that policy (“policy outcomes”), and (c)the roles and responsibilities of persons (whether the Secretary of State, the economic regulator or other persons) who are involved in implementing that policy or who have other functions that are affected by it. Part 3 provides for licensing of hydrogen production and transportation. Part 5 identifies new technologies such as low-carbon heat schemes and hydrogen grid trials. Part 5 regulates the functions and powers for the Independent System Operator and Planner. The matters referred to in subsection (2)(a) are— (a)coordinating and directing the flow of electricity onto and over transmission systems; (b)making and administering arrangements for the provision of services for the purpose of facilitating the co-ordination of the flow of electricity onto and over transmission systems; (c)carrying out strategic planning and forecasting in connection with— (i)the development of transmission systems, (ii)the provision of services referred to in paragraph (b), and (iii)other arrangements relating to the conveyance or supply of electricity; (d)carrying out strategic planning and forecasting in connection with— (i)the development of pipe-line systems for the conveyance of gas, and (ii)other arrangements relating to the conveyance or supply of gas; (e)providing advice, analysis or information in relation to the matters mentioned in section 171(1).
The Act also covers governance of gas and electricity industry codes (Part 6) financial support for energy-intensive activities (Part 7), heat networks (Part 8), energy smart appliances and load control (Part 9), energy performance of premises (Part 10), energy savings opportunity schemes (Part 11), the resilience of the core fuel sector (Part 12), offshore energy production including environmental protection (Part 13), licensing, and decommissioning, and the civil nuclear sector including the Civil Nuclear Constabulary and pensions (Part 14), along with related purposes.
