Environmental Permitting (England and Wales) (Amendment) Regulations 2018 (S.I. 110 of 2018).

These Regulations principally amend the Environmental Permitting (England and Wales) Regulations 2016. They also amend the Air Quality Standard Regulations 2010, and the Air Quality Standard (Wales) Regulations 2010. These Regulations amends the principal Regulations to add provisions relating to the environmental permitting for regime medium combustion plants ( MCPs ). It transposes the Medium Combustion Plant Directive (Directive 2015/2193/EU), which lays down rules to control emissions of sulphur dioxide, nitrogen oxides and dust from MCPs. It also amends Schedule 26 to the principal Regulations to remove the disapplication of the availability of enforcement undertakings in respect of offences in relation to a flood risk activity, as access to enforcement undertakings is now available under the Regulatory Enforcement and Sanctions Act 2008. Air Quality Standard Regulations 2010, and the Air Quality Standard (Wales) Regulations 2010 are amended as part of the transposition of the Medium Combustion Plant Directive. The amendments concern preparation of air quality plans.
