Abstract
Regulations to create import conditions for live bivalve molluscs and other shellfish which are imported into Great Britain. The Regulations carry the following titles: Citation and Commencement (1); Interpretation (2); General Restrictions on Importing Live Bivalve Molluscs or other Shellfish (3); Additional Conditions in Relation to certain Third Country Imports (4); Amendment of Principal Regulations (5); Enforcement and Penalties (6); Transitional Provisions (7); Revocation (8).
They implement the remaining parts of Council Directive 91/492/EC laying down health conditions for the production and placing on the market of live bivalve molluscs which where not implemented by the principal Regulations of 1992. They also implement EC Council Directive 93/383/EC on reference laboratories for the monitoring of biotoxins in relation to imported live bivalve molluscs and other shellfish only. Regulation 3 sets out the conditions of importation in general and regulation 4 adds requirements to these conditions for products imported from countries outside of the EEA. The amendments to the principal Regulations which are of a substantive nature relate to relaying areas, import conditions for products from Northern Ireland and the Isle of Man, approval of purification and dispatch centres, sample analysis requirements, and microbiological testing.
