Abstract
These Regulations implement Annex II (Regulations for the Control of Pollution by Noxious Liquid Substances in Bulk) of MARPOL 73/78. Part 2 provides for “relevant requirements” in respect of an Noxious Liquid Substances in Bulk ship (NLS ship), intended as the relevant requirements concerning structure, equipment, systems, fittings, arrangements and materials specified in paragraph (2) in relation to that ship. These requirements are checked through compulsory surveys (initial, renewal, annual, immediate, additional survey) and when the surveyor is satisfied that the ship complies with the relevant requirements which apply to that ship the Minister may issue a NLS certificate. The Regulations provide for the discipline of NLS certification. Part 3 concerns operational requirements and envisages control of discharges of Noxious Liquid Substances from ships, unloading arrangements, loading and carriage in bulk of noxious liquid substances, marine Pollution Emergency Plan, etc. Part 4 regulates the NLS Polar code. Part 5 includes offences, inspection, appeal, etc.
