Abstract
These Regulations implement Directive 2011/92/EU on the assessment of the effects of certain public and private projects on the environment; activities related to proposed offshore oil and gas exploration and production, gas unloading and storage, and storage of carbon dioxide ( offshore projects ). The Instrument makes provision for the Secretary of State s consideration of the environmental impacts of proposed offshore projects when deciding whether to agree to the grant of consent for such projects.
The Instrument applies to projects where they take place wholly or partly within (a) tidal waters and parts of the sea adjacent to the United Kingdom from the low water mark up to the seaward limits of territorial waters; (b) waters in any area for the time being designated under section 1(7) of the Continental Shelf Act 1964 F7 (designation of areas of continental shelf); (c) the seabed and subsoil under the waters referred to in paragraphs (a) and (b).
