The Plant Health (Phytosanitary Conditions) (Amendment) (EU Exit) Regulations 2020 (S.I. 2020 No. 1527).

These Regulations contain amendments to the Commission Implementing Regulation (EU) 2019/2072 establishing uniform conditions for the implementation of Regulation (EU) 2016/2031 on protective measures against pests of plants. The purpose of this instrument is to protect biosecurity and support trade by ensuring that effective phytosanitary controls continue to operate within GB and between GB and the EU at the end of the Transition Period on 31 December 2020.
Part 2 contains several amendments that adapt the headings and Regulation content to the domestic context, such as substituting "GB" to "Union" and including other references to domestic legislation or GB boarders. In particular, Art. 1 is substituted by: 1. This Regulation makes provision for the purposes of Regulation (EU) 2016/2031. 1A. It makes provision about: (a) GB quarantine pests, provisional GB quarantine pests, PFA quarantine pests and GB regulated non-quarantine pests; and (b) measures in relation to the introduction of plants, plant products and other objects into Great Britain and the movement of plants, plant products and other objects within Great Britain to reduce the risks in connection with those pests to an acceptable level. Article 3A adds a new Annex 2A that provides a list of provisional GB quarantine pests (including fungi, insects and mites, and viruses, viroids and phytoplasmas).
Part 2 and subsequent Schedules contains several changes to Annexes 1 to 14 of the Commission Implementing Regulation (EU) 2019/2072. Annex 3 (List of PFA quarantine pests and GB pest-free areas) substitute the Annex in Schedule 3; Annex 4 (List of GB regulated non-quarantine pests - RNQP - and their respective plants for planting) substitute the Annex in Schedule 4; Annex 5 (Measures to prevent the presence of RNQPs on specific plants for planting) substitute the Annex in Schedule 5; Annex 6 (List of plants, plant products and other objects which may not be introduced into Great Britain if originating or dispatched from certain third countries) substitute the Annex in Schedule 6; Annex 7 (List of plants, plant products and other objects o) substitute the Annex in Schedule 7; Annex 8 (List of plants, plant products and other objects originating in a CD territory or Great Britain and the special requirements for their introduction into Great Britain from a CD territory or their movement within Great Britain) substitute the Annex in Schedule 8; Annex 10 (List of plants, plant products and other objects to be introduced into, or moved within, GB pest-free areas and corresponding special requirements) substitute the Annex in Schedule 9; Annex 11 (List of plants, plant products and other objects and the respective third countries of origin or dispatch in respect of which phytosanitary certificates are required) substitute the Annex in Schedule 10; Annex 13 (List of plants, plant products and other objects for which a UK plant passport is required for their movement within Great Britain or for their introduction into Great Britain from a CD territory) substitute the Annex in Schedule 11.
