Abstract
The Regulations control the operation of any installations or mobile plant carrying out any of the activities listed in Part 1 of Schedule 1 to the Regulations. They transpose in Northern Ireland Directive 2010/75/EU of the European Parliament and of the Council on industrial emissions (integrated pollution prevention and control). They also provide for enforcement powers and for appeals to the Planning Appeals Commission. Depending upon the kind of activities (listed in Schedule 1), integrated pollution control shall be carried out by the chief inspector, whereas air pollution control shall be carried out by the chief inspector or district councils.
The Regulations cover a wide range of activities including the manufacturing of biocides, fertilizers and other chemicals for agricultural use and intensive farming. They also provide with respect to best available techniques. Plants treating organic waste from food, wood, etc. are excluded in part from the application sphere of these Regulations.
