Abstract
This Order enforces in England and Wales Council Regulation (EC) No 1005/2008 and Commission Regulation (EC) No 1010/2009 establishing restrictions and obligations relating to illegal, unreported and unregulated fishing. It applies to English and Welsh fishing boats, wherever they are, and to other fishing boats within the zones of England and Wales (within British fishery limits with exception of the zones of Scotland and Northern Ireland). The Order, among other things: designates the Secretary of State and the Welsh Ministers as the competent authority for the purposes of the Council and the Commission Regulations; provides for controls on movement of consignments of fishery products; permits movement of such consignments under certain circumstances; provides for the refusal of importation or permission to use transshipment facilities in circumstances where a landing or transshipment declaration has not been submitted in accordance with Article 8 of the Council Regulation or Article 3 of the Commission Regulation; provides for a right of appeal to a court of summary jurisdiction in circumstances where importation or permission to use transshipment facilities is refused; and provides for powers of British sea-fishery officers.
