Abstract
These Regulations amend other Regulations and EU legislation directly applicable in the United Kingdom to address failures of retained EU law to operate effectively and other deficiencies (in particular under paragraphs (a), (b), (c), (e) and (g) of section 8(2)) of the European Union (Withdrawal) Act 2018 arising from the withdrawal of the United Kingdom from the European Union. These Regulations make amendments to legislation in the field of environmental protection and, in particular, amend legislation relating to the import and placing on the market of timber and timber products to minimise the risk of placing illegally harvested timber and timber products derived from such timber on the market. Part 2 amends subordinate legislation and Part 3 amends retained EU Regulations. The EU legislation that applies amended to the UK includes Commission Regulation (EC) No. 1024/2008 laying down detailed measures for the implementation of Council Regulation (EC) No. 2173/2005 on the establishment of a FLEGT licensing scheme for imports of timber into the European Community, the European Parliament and of the Council laying down the obligations of operators who place timber and timber products on the market, Commission Delegated Regulation (EU) No. 363/2012 on the procedural rules for the recognition and withdrawal of recognition of monitoring organisations as provided for in Regulation (EU) No. 995/2010 of the European Parliament and of the Council laying down the obligations of operators who place timber and timber products on the market, and Commission Implementing Regulation (EU) No. 607/2012 on the detailed rules concerning the due diligence system and the frequency and nature of the checks on monitoring organisations as provided for in Regulation (EU) No. 995/2010.
