Town and Country Planning (General Permitted Development) (Scotland) Amendment Order 2017 (S.I. No. 189 of 2017).

This Order amends the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 to: update the definition of “European site”; insert new articles 7ZA to 7ZE imposing obligations on planning authorities with regard to applications by electronic communications code operators for a determination as to whether prior approval is required with regard to the siting and appearance of new ground based masts. An European site now includes also a site in the meaning of Directive 2009/147/EC of the European Parliament and of the Council on the conservation of wild birds.
