Abstract
These Regulations make provision in connection with applications for the modification and discharge of planning obligations entered into under section 75 of the Town and Country Planning (Scotland) Act 1997 and related appeals.
Section 75 stipulates that a planning obligation may not be modified or discharged except by agreement between the planning authority and a person against whom that obligation is enforceable. Where a planning authority does not undertake proper action or determines that a planning obligation is to continue to have effect without modification, the applicant may appeal to the Scottish Ministers.
