Abstract
This Act lays down rules for the establishment of the Exclusive Economic Zone as an area beyond and adjacent to the territorial sea out to a line every point of which is at a distance of 200 nautical miles from the nearest point of the baselines. The boundary lines of EEZ shall be marked on charts or maps within the demand of the Minister. The rights in and jurisdiction over the EEZ of the Government of Grenada shall include the exploration, exploitation, conservation, protection or management of the natural living and non-living resources of the seabed, subsoil and superjacent waters; management and safety of shipping and other economic activities; protection of the marine environment and the prevention marine pollution; regulation and control of scientific research; the construction, maintenance or use of structures or devices and all other activities relating to the economic exploration and exploitation of the EEZ; and all other rights and jurisdiction recognized by international law. The exploitation of resources in the EEZ is subject to an agreement with the Government of Grenada or a permit granted by the Minister, however this shall not apply to fishing by a citizen of Grenada in or from a Grenadian vessel. Part III of this Act sets forth provisions on the conditions, content, variation, revocation and suspension of fishing permit for the domestic and foreign fishing in the EEZ or in the territorial waters. Part IV specifies the persons qualified to be marine conservation officers, as well as their authorities and duties. In case of seizure, the marine conservation officer may sell fish to avoid spoilage or decay of any fish. The Minister may make regulations consistent with this Act for the effective implementation of the provisions of this Act. Moreover, the Minister may give directions regarding the disposal or release of any vessel and their structure, equipment, or device within a court order to be forfeited under this Act or the regulations.
