Abstract
The Act establishes the Commission on human rights and Administrative Justice with rules concerning composition, qualification of commissioners, terms and conditions of service, and procedure for removal of commissioners. The Act also recognises the principle of independence of Commission and Commissioners in relation to any person or authority.
Part II lists the Commission’s functions and recognises some special powers of investigation, and of initiation of legal proceedings. Commission’s functions include: (a) to investigate complaints of violations of fundamental rights and freedoms, injustice, corruption, abuse of power and unfair treatment of any person by a public officer in the exercise of his official duties; (b) to investigate complaints concerning the functioning of public representatives such as the Public Services Commission, the administrative organs of the State, the offices of the Regional Co-ordinating Council and the District Assembly, the Armed Forces, the Police Service, among others; (c) to investigate complaints concerning practices and actions by persons, private enterprises and other institutions where those complaints allege violations of fundamental rights and freedoms under the Constitution; (d) to take appropriate action to call for the remedying, correction and reversal; (h) to report annually to Parliament on the performance of its functions, etc.
Part III regulates the complain process and form, investigation procedure, evidence, documents handling and recognises the principle of “maintenance of secrecy” for Commissioner and every person holding an office or appointment under the Commission in respect of all matters that come to their knowledge in the exercise of their functions. Part IV is procedures after investigation by the Commission. Part V contains miscellaneous provisions such as offences and penalties and proceeding privileged for Commission or against any person holding an office or appointment under the Commission.
