Abstract
This Act provides for the protection of biodiversity in The Gambia and provides with respect to the establishment and management of Protected Areas. It also establishes a Biodiversity Fund and regulates hunting and harvesting of scheduled biological resources and the import and export of such resources. “Biological resource” means a genetic organism or other biotic component of eco-systems with actual or potential use or value for humanity. “Scheduled biological resource” means a Scheduled biological resources listed in the scheduled or such other biological resource as may be specified by the Secretary of State by regulations published in the Gazette.
The Act consists of 97 sections divided into 13 Parts: Preliminary (I); Administration (II); Protected Areas (III); Management of Protected Areas (IV); Biodiversity Fund (V); Control of Hunting and Harvesting (VI); Prohibited methods of Hunting And Harvesting (VII); Sale of Schedule Resources (VIII); Import and Export of Schedules Biological Resources (IX); Enforcement Powers (X); Presumptions, Penalties And Forfeitures (XI); Biodiversity And Wildlife Coordination Mechanism (XII); Miscellaneous (XIII).
The Secretary of State shall be responsible for the administration of this Act. Also directors of various departments or public agencies shall be responsible for the carrying into effect of provisions of this Act. The Department of Parks and Wildlife shall cooperate with national and international organisations and bodies on matters of biodiversity and wildlife conservation. A Biodiversity and Wildlife Training Center shall be established.
The Secretary of State may, on recommendation of the Directors, declare Protected Areas for the purposes of biodiversity and wildlife conservation and sustainable use. The Act sets out conditions for and procedures of such declaration. The Protected Areas shall be classified into national parks, national reserves, fisheries protected areas, local sanctuaries and culture and heritage sites defined by Regulations made by the Secretary of State. The Director of parks and wildlife communities Management shall encourage community participation, in the form of a Local Biodiversity Areas and Wildlife Committee.
A National Wildlife Inventory and a Wildlife Action Programme shall be prepared every ten years.
