Abstract
This Act, consisting of sixty-one sections, and divided into eleven parts, provides for establishing a Commission in order to: promote competition in the supply of goods and services, prevent collusive agreements, bid rigging, improve the understanding of the benefits of competition. The Act applies to the supply or acquisition of goods and services, and thus concerns the following matters: intellectual property rights of an enterprise; establishment of the Competition Commission and appointment of its members and of the staff; functions and powers of the Commission, including: conducting investigations into suspected breaches of the prohibition of restrictive agreements; monitoring compliance with the provisions of the Act; publishing guidelines on the economic and legal analysis, and procedural rules. Further matters include: funding for the Commission; fees and other charges to be paid by parties to restrictive business practices investigated by the Commission; specification of restrictive business practices: collusive agreements distorting competition, bid-rigging agreements, horizontal and vertical agreements subject to investigation, monopoly situations; power to obtain information during investigations and inspections; penalties and remedies; appeal to a special Court.
