Abstract
Regulations to implement provisions of the Forest Act 1998. They provide in particular for management and protection of and control of activities of various kinds of forests as defined by the Act.
The 43 regulations are divided into 9 Parts: Preliminary (I); general provisions (II); Management plans and forest inventories (III); Forest protection (IV); Licences (V); Permits (VI); Authorization of exploitation in community forests (VII); Penalties (VIII); Miscellaneous (IX).
Director of Forestry in the Forestry Department shall have the power to set fees and royalties to be paid for anything authorized under the Act or these Regulations (reg. 3). Regulation 4 defines requirements for the transport of timber in the Gambia. The export of any forest produce, except specified items, is prohibited except with the written permission of the Secretary of State (reg. 5). The National Forest Inventory in the sense of the Act shall be prepared by the Director in accordance with specifications laid down in the Second Schedule. Regulation 8 makes provision withy respect to forest inventories conducted under sections 93 to 95 of the Act. Regulations 10 to 12 provide rules relative to various kinds of management plans prepared under section 96 of the Act. No person shall cut, fell, burn, uproot, injure, or remove any forest tree outside forests without obtaining a permit from the Forestry Department (reg. 15). District heads or village heads and communities shall be responsible for fire control (reg. 16). Regulations 17 to 23 define other responsibilities with respect to specified categories of forests. No person shall fell or mutilate any vegetation in any strip of wooded area left entirely for anti-erosion except with the express approval the Forestry Department (reg. 25). Any exploitation of forest produce in a community forest for commercial purpose shall be done in accordance with the management plan and with a valid licence or permit issued to the forest committee by the Forestry Department and under the provision of section 90 of the Act (reg. 39).
