Abstract
This Act, made up of eleven parts and six schedules, establishes the Gambia Investment and Export Promotion Agency. The Agency shall promote the creation of a conducive business environment, to spur investment and export-led growth, and support the development of sustainable local enterprises in order to build their capacity to effectively contribute to employment, economic growth and wealth creation. The description of investment promotions measures, the fields of investments and their form, the related guarantees and the dispute resolutions provisions are detailed by part five of the Act.
The Act sets up the functions of the Agency which is basically the promotion of investments as well as the development of the export potential of businesses in Gambia, the encouraging and support of the development of sustainable and capable micro, small and medium enterprises. The Act also rules the composition of the Agency and its functioning as well as its management and administration. Specific financial provisions are also foreseen, such as the funds of the Agency and its investments.
Part six and seven are instead dedicated to the incentives granted to promote the investments, according to priority sectors and areas specified in Schedules II and III. Parts eight and nine regulate the export promotion and the export processing zones and the enterprise support. A Competitiveness Improvement Forum is established in Part ten to encourage measures for the growth, to establish working groups, to promote the cooperation between government institutions and private and public institutions on the implementation of policies and strategies etc. Miscellaneous provisions terminate the Act.
