Presidential Decree No. 45 establishing animal health conditions governing intra-Community trade and imports from third countries of poultry and hatching eggs, in compliance with Council Directive 2009/158/EC.

Abstract
This Decree lays down animal health conditions governing intra-Community trade in, and imports from third countries of, poultry and hatching eggs. The provisions of the Decree shall not apply to poultry for exhibitions, show or contests. For the purposes of this Decree official veterinarian and third country mean the official veterinarian and third countries as defined in Presidential Order No. 245/2006. the Decree is composed of 34 articles, divided into four Chapters as follows: Chapter I, General provisions (articles 1-2); Chapter II, Rules for intra-Community trade (articles 3-21); Chapter III, Rules for imports from third countries (articles 22-28); Chapter IV, Common provisions (articles 29-34). Attached to this Decree are five Annexes providing details regarding the designated national reference laboratory for avian diseases (Annex I), approval of establishments (Annex II), poultry vaccination conditions (Annex III), veterinary Certificates for intra-community trade (Models 1 to 6) (Annex IV), compulsorily notifiable diseases (Avian influenza and Newcastle disease) (Annex V).

Entry into force notes
The Decree shall enter into force on 1 January 2010 except for articles 30 (sanctions), 31 (power to the Minister of Agriculture to further provide for related issues) and 32 (repeal of relevant legislation) which shall enter into force on the day of its publication in the Official Gazette.
