Abstract
This Act makes provision with respect to the constitution, registration, operation, etc. of cooperative societies in Guyana. The Act consists of 60 sections divided into 11 Parts: Preliminary (I); Registration (II); Duties and privileges of societies (III); Rights and liabilities of members (IV); Property and funds of registered societies (V); Audit, inspection and inquiry (VI); Dissolution (VII); Surcharge and attachment (VIII); Disputes (IX); Regulations (X); Miscellaneous (XI).
There shall be a Commissioner of Cooperative Development and such other officers as may be required to assist the Commissioner (sect. 3). Section 5 sets out the conditions of registration as a cooperative society. An application for registration shall be made to the Commissioner. The registration shall render the society a body corporate. Section 13 concerns the disposal of (agricultural) produce of its members by a society. A society may prescribe in its rules that the whole or part of the produce shall be disposed of through the cooperative society and may prescribe a penalty for non-compliance by its members with such rule. Section 49 concerns the settlement of disputes within societies, among members, and between registered societies. Disputes shall be submitted to the Commissioner.
