Abstract
The Legislation establishes a comprehensive legal and regulatory framework to prevent, prepare for, respond to, and mitigate oil pollution incidents within the territory, territorial sea, exclusive economic zone, and maritime zones of Guyana. The primary objective of this Act is to safeguard the marine and coastal environment, protect wild species, habitats, and natural resources from the destructive impacts of oil spills, and establish clear legal obligations regarding financial responsibility, liability, and compensation for environmental damage resulting from oil pollution.
To achieve these objectives, the Act establishes the National Oil Spill Response Commission as the primary competent authority responsible for national preparedness, the development of the National Oil Spill Contingency Plan, and the coordination of overall risk assessment and preventative measures. Additionally, the Act creates the National Oil Spill Emergency Response Committee, which is mandated to direct operational responses, monitor real-time spill data collection, and implement emergency plans during actual pollution incidents. The legislation mandates strict notification protocols, requiring vessel masters, operators of offshore installations, and facility managers to immediately report any oil discharge or imminent threat of a spill to the designated authorities.
In terms of enforcement and liability, the Act introduces a strict liability regime for oil pollution damage, holding polluters responsible for the costs of clean-up, response operations, and environmental damage valuation without requiring proof of fault or negligence. To ensure compliance, the law empowers inspectors to carry out regular inspections, environmental audits, and compliance monitoring of vessels and oil handling facilities. Compulsory financial security or insurance is required for operators to cover potential liability. Finally, the Third Schedule of the Act details comprehensive administrative and criminal offences, prescribing substantial financial penalties and corporate fines for non-compliance, unauthorized discharges, and failure to report pollution incidents.
