Decision on the conditions and criteria to be met by agricultural and food products in public procurement.

This Decision, due to short supply disturbances and other disturbances caused by market restrictions resulting from the declared epidemic of COVID-19 disease caused by SARS-CoV-2 virus on the territory of the Republic of Croatia, determines the conditions and criteria for procurement of agricultural and food products.
In particular, during the disease COVID-19, the contracting authority shall procure agricultural and food products from economic operators, compulsorily applying the selection criteria of article 284 (paragraph 7) of the Public Procurement Act relating to the quality of agricultural and food products, paying particular attention to the fact that the same are produced in season, with eco-friendly and integrated products, etc, ensuring greater freshness or lower environmental burden in terms of shorter transport, regardless of the type of procurement procedure.
The contracting authority may procure increased quantities of agricultural and food products directly from another economic operator using a negotiated procedure without prior publication in accordance with article 131, paragraph 1, item 3 and article 132, item 3 of the Public Procurement Act, if the contracting entity is unable to deliver the contracted quantities in accordance with article 284 (paragraph 7) of the Croatian Public Procurement Act.
