Decree on compensation for damages based on alienation of mineral raw materials.

This Decree determines the compensation for damages based on alienation of mineral raw materials caused by the action of a natural or legal person who performed mining works without a valid legal basis. A natural or legal person who performed mining works without a valid legal basis is obliged to compensate the Republic of Croatia, as the owner of the mineral treasure, for the damage caused by the illegal performance of the works. The type and quantity of illegally mined or obtained mineral raw materials is determined by the mining inspector of the State Inspectorate on the basis of the minutes of the performed inspection supervision. The market value of mineral raw materials is determined based on the known values of mineral raw materials in the deposit, which were mined or extracted in the Republic of Croatia in the previous three years. Compensation for damages based on alienation of mineral raw materials is determined according to the formula given in article 5.
