Abstract
This Law establishes general bases for the protection and promotion of gender equality as fundamental values of the constitutional order of the Republic of Croatia, and defines and regulates the method of protection against discrimination based on gender and the creation of equal opportunities for women and men. No one may suffer adverse consequences for having given a statement before the competent authority as a witness or victim of discrimination based on gender or for warning the public about a case of discrimination. The provisions of this Act may not be interpreted or applied in a way that would limit or diminish the content of the guarantees on gender equality that stem from the general rules of international law, the acquis of the European Community, the United Nations Convention on the Elimination of All Forms of Discrimination against Women, the United Nations Treaties on Civil and political rights, i.e. economic, social and cultural rights, and the European Convention for the Protection of Human Rights and Fundamental Freedoms.
Gender equality means that women and men are equally present in all areas of public and private life, that they have equal status, equal opportunities to exercise all rights, as well as equal benefit from the achieved results. Discrimination on the basis of gender means any difference, exclusion or restriction made on the basis of gender, the consequence or purpose of which is to endanger or prevent the recognition, enjoyment or use of human rights and basic freedoms in the political, economic, social, cultural, civil or other areas based on the equality of men and women, educational, economic, social, cultural, civil and any other area of life. Discrimination based on marital and family status is prohibited. Less favorable treatment of women on the basis of pregnancy and maternity is considered discrimination. Discrimination based on sexual orientation is prohibited. Discrimination in relation to the possibilities of obtaining and purchasing goods, as well as discrimination in the provision and access to services, is prohibited. Inciting another person to discriminate is considered discrimination within the meaning of this Law, if it is done with intent.
