Regulation on the implementation of measure II.13. "Insurance of aquaculture stocks".

This Regulation determines the implementation of the award of support within measure II.13. "Ensuring aquaculture stocks" within the framework of Priority 2 of the European Union "Encouraging sustainable aquaculture activities and processing and placing on the market fishery and aquaculture products, which contributes to the security of food supply in the Union" as part of the implementation of the Fisheries and Aquaculture Program of the Republic of Croatia for the program period 2021-2027. The subject of support is compensation for the insurance premium based on aquaculture stock insurance policies that compensate economic losses caused by at least one of the following: a) natural disasters; b) sudden changes in the quality and quantity of water for which the business entity is not responsible; c) diseases in aquaculture for which the economic entity is not responsible; d) breakdowns or destruction of production facilities for which the economic entity is not responsible. The following conditions must be met in order to receive support: a) the user must be the holder of a valid license for aquaculture; b) the conditions and criteria from Article 3 of this Ordinance must be met; c) the insurance premium that is the subject of support must not be financed by any other public contributions; d) the operation must not be physically completed or carried out in full at the time of submission of the Request for Support, i.e. the insurance premium must not be paid in full and the insurance policy must be valid at the time of submission of the Request for Support; e) the user must have settled financial obligations to the State Budget of the Republic of Croatia on the basis of public benefits; f) the user must not be in bankruptcy, pre-bankruptcy proceedings, liquidation or blockade; g) the user must not have a conflict of interest with the insurer; h) as an exception to point g) of this paragraph, in the event of a possible conflict of interest, the user is obliged to prove in an appropriate manner that the impartial and objective business is not threatened, i.e. that the business of the user and the insurer is conducted in accordance with normal market conditions and that it does not lead to giving economic advantages of both users and insurers; i) the user must give consent to be included in the list published in accordance with Article 49, paragraph 3 of Regulation (EU) no. 2021/1060.
