Abstract
This Act establishes the legal framework for the management, utilization, and protection of land assets owned by the Hungarian State. The Act defines the scope of the National Land Fund, which includes all state-owned parcels classified as agricultural land, forests, and other areas utilized for primary production. The central objective of the Act is to ensure the transparent and efficient administration of these assets, prioritizing the preservation of natural resources and the promotion of a stable, sustainable agricultural structure.
The Act designates a specific state entity to exercise ownership rights over these lands, outlining its responsibilities in land acquisition, leasing, and sales. It mandates that the management of state land must support specific public policy goals, such as assisting local farmers, facilitating the establishment of family farms, and providing land for young agricultural producers. The Act imposes strict procedural requirements for the disposal or leasing of state property, typically requiring public auctions or competitive tenders to ensure market-based and equitable access.
Furthermore, the Act grants the state certain pre-emption rights to prevent the fragmentation of agricultural holdings and to consolidate land for environmental or infrastructure projects. It also establishes the National Land Fund Council, a supervisory body tasked with monitoring the activities of the management organization and ensuring that all transactions comply with national interests and the long-term protection of the country's fertile soil.
