Abstract
This Government Regulation establishes the governance framework for the export of strategic natural resource commodities within Indonesia. The primary objective of this instrument is to manage the export of these key natural resources directly through state-authorized channels to safeguard domestic supply stability, bolster national economic resilience, increase value-added production, support sustainable national development, and maximize public prosperity in accordance with Article 33 of the 1945 Constitution.
The regulation mandates that designated strategic natural resource commodities may only be exported by specifically appointed Export State-Owned Enterprises (BUMN Ekspor), which act either as the direct owners or as the sole intermediaries. For the initial phase, these designated strategic commodities include coal, palm oil, and ferro-alloys (iron alloys). The Ministry of Trade is responsible for issuing the technical regulations defining the specific types of commodities under these categories, while future expansions into other food or non-food strategic commodities will be determined through ministerial coordination meetings.
Under this governance structure, the designated Export State-Owned Enterprises hold the authority to determine selling prices and set reasonable margin levels in compliance with existing laws. Operational export management measures include export controls, technical verifications or tracking, and regulation of shipping and export insurance. Certain business entities may be exempted from the state-owned enterprise export mandate if they hold valid state contracts that fulfill specific criteria regarding investment, divestment, and domestic processing or refining.
The regulation includes transitional provisions requiring that all designated strategic resource exports be routed through the authorized state enterprises no later than 31 December 2026. Active sales contracts signed prior to 1 June 2026 are subject to evaluation by the designated entities. Responsibility for general guidance, development, and supervision of this export governance framework is distributed among the respective ministers and heads of relevant non-ministerial government institutions according to their specific jurisdictions.
