Abstract
This regulation sets the guidelines and procedures for controlling the implementation of investment activities in the country. The regulation defines the scope of investment control, which includes monitoring, guidance, and supervision of investors who have obtained investment permits. It also specifies the authority of BKPM, provincial and district governments, free trade zone and free port authorities, and special economic zone administrators to carry out the control according to their respective jurisdictions.
The regulation outlines the rights and obligations of investors, such as obtaining legal certainty and protection, submitting periodic reports on investment realization and activities, applying good corporate governance and social responsibility principles, respecting local culture and environment, and complying with all applicable laws and regulations.
The regulation describes the control activities that are conducted by BKPM and other authorities, such as verifying and evaluating the data reported by investors, conducting field inspections, and providing guidance and facilitation to resolve problems. It also stipulates the administrative sanctions that can be imposed on investors who violate the regulation, such as restriction, freezing, revocation, and closure of their business and/or investment facilities.
