Abstract
This Presidential Regulation, implementing provisions of Article 43 paragraph (4) of Law no. 32 of 2014 concerning Maritime Affairs in its last amended version, and Article 48 of Government Regulation no. 32 of 2019 concerning Marine Spatial Planning, concerns the Zoning Plan for the waters and jurisdictional areas in the Malacca Strait Interregional Area, including: inland waters, archipelagic waters and territorial sea. This Regulation defines the following relevant terms: inter-regional sea areas; coastal waters; marine spatial structure; marine spatial pattern; cultivation area; protected areas; public utilisation area; conservation area; national strategic area, where spatial planning is prioritised; shipping channels, considered safe and secure for navigation; maximum sea boundary line; port and fishing port; fisheries management area for fishing and fish cultivation, including: Indonesian waters, the Indonesian Exclusive Economic Zone, rivers, lakes, reservoirs, swamps and other bodies of water; mining activity; marine tourism; activities related to processing and marketing of salt; fish resources; central and regional governments; customary law communities.
The Regulation concerns: delimitation of the boundaries of the zoning plan for the Malacca Strait Interregional Area; the operationalisation of the national regional spatial plan; coordinating and synchronising development programs in the Malacca Strait interregional area; definition of the objectives of the Spatial Plan: coordination of the development implementation in the Malacca Strait, determination of marine spatial patterns outside coastal water and in marine conservation areas, controlling the use of marine space within the Malacca Strait; preparation of water area zoning plan and definition of its goals and objectives, including: protection of migration routes of marine resources, control of marine space utilisation activities, increasing competitive trade activities oriented towards maritime transportation service, arrangement of marine space to support shipping activities, installing a fishing vessel monitoring system, development of mineral exploration and exploitation of oil and natural gas, increasing ecosystem rehabilitation activities, prioritising the use of environmentally friendly technology for capture fisheries activities.
Further matters covered by this Regulation include: preparation of the marine spatial structure Plan in water areas, with marine growth centres and marine infrastructure network system; strengthening of centres for capture fisheries and aquaculture activities; implementation of basic fisheries port services; public use of areas with national strategic value; protection of marine biota and migratory species, including sea turtles; use of space in inland waters; permitted and restricted activities; jurisdictional zoning plan and definition of goals, objectives and strategies; assessment of the implementation of the various zoning plans; incentives and disincentives provided by central and local governments; community participation in the application and implementation of marine spatial planning.
