Abstract
This Presidential Regulation, implementing article 43 paragraph (4) of Law no. 32 of 2014 concerning Maritime Affairs and article 48 of Government Regulation no. 32 of 2019 concerning Marine Spatial Planning, concerns the creation and management of the Zoning Plan for the Inter-regional sea areas of North Natuna-Natuna. The Presidential Regulation concerns: sea; interregional sea areas; coastal water management; protected area; conservation area; national strategic area; mining area; space utilisation regulations; fisheries management area; production and marketing of salt; marine tourism; marine biotechnology industry centre; fish resources; fishing port; continental shelf, Exclusive Economic Zone; territorial waters including inland waters, archipelagic waters and territorial sea; boundaries of the Zoning Plan. According to the Regulation, the Zoning Plan for the Natuna Sea Interregional Area is a coordinating instrument for defining national spatial planning and for developing programs in the area.
This Regulation concerns purposes of the territorial waters Zoning Plan and definition and contents of related Policy and Strategy, including creation of a marine growth centre to drive regional economy; determination of an effective network of sea infrastructures; realisation of fishing and aquaculture areas; creation of environmentally friendly mining zone; opening to competitive marine tourism; management of marine protected areas; preservation of marine biodiversity; controlling the utilisation of the sea space; increasing fishery ports; development of fishing activity centres; optimisation of navigation activities; sea space utilisation for business related to oil and natural gas exploitation and for mining activities concerning coal and minerals; development of environmental protection measures; prevention and control of pollution in the sea; increasing of resilience of the marine environment through disaster mitigation and climate change adaptation. The Regulation defines the Marine Spatial Structure Plan in deep waters and its content; marine infrastructure and facilities network system; the Spatial pattern Plan for energy management, coastal management, mining, aquaculture, indication of marine protected areas; public utilisation areas; application of traditional fishing rights and fishing interests of Malaysia.
Other matters covered by this Regulation include: Areas of national strategic value and their utilisation; migration of wild species including turtles; national ports arrangement; provisions regarding spatial sea utilisation and activities allowed, permissible and not allowed, including type of fishing gears, size of fishing vessels, disposal of hazardous and toxic waste from ships, collection of corals; controls on utilisation of marine space; incentives from the central and governments to the communities; penalties; community management of sea spatial planning.
