Abstract
These Regulations give effect to Article 92 of Council Regulation (EC) No. 1224/2009 establishing a Community control system for ensuring compliance with the rules of the common fisheries policy, which requires the establishment of a point system to be applied in case of commitment of a serious infringement by any vessel within the EEZ of Ireland or by an Irish vessel. The accumulation of points for persistent serious infringements of the Common Fisheries Policy will lead to the suspension of a sea fishing boat licence or to the permanent withdrawal of a licence. The Sea Fisheries Protection Authority shall establish the system and be responsible for the assignment of points, whereas the Licensing Authority as defined by the Fisheries (Amendment) Act 2003 shall be responsible for the recording of points assigned to the licence of an Irish registered fishing vessel. The Regulations establish an independent appeals officer to hear appeals against the assignment of points.
