Abstract
This Statutory Instrument provides for the establishment of a Determination Panel comprised of 3 independent legal professionals nominated by the Attorney General to determine if on the balance of probabilities a serious infringement occurred. The instrument also establishes an independent Appeals Officer to review the decision of the Determination Panel on the request of the licence holder. The accumulation of points for persistent serious infringements of the Common Fisheries Policy will lead to the suspension of a sea fishing boat licence for a period from 2 months to one year. In extreme cases persistent serious fisheries infringements could lead to the permanent withdrawal of a licence. In determining whether an alleged serious infringement has occurred, the Determination Panel shall have regard to the criteria set out in Article 3(2) of the IUU Regulation (Council Regulation (EC) No 1005/2008).
