Abstract
These Regulations amend the European Union (Special Conditions Governing the Import of Certain Food from Certain Third Countries due to Contamination Risk by Aflatoxins) Regulations 2015 so as to, among other things, give partial effect to Commission Implementing Regulation (EU) 2019/890 of imposing special conditions governing the import of groundnuts from Gambia and Sudan and amending Regulation (EC) No. 669/2009 and Implementing Regulation (EU) No. 884/2014. The Regulations insert in regulation 11 (offences) the following paragraph: “(10) Notwithstanding paragraph (2)(j), (l), (m) and (p), a person who imports a consignment of food referred to in Article 1(1)(o) or (p) of EU Regulation 884/2014 which left the country of origin before 18 June 2019, and fails to— (a) submit the results of sampling and analysis in accordance with Regulation 7(1)(d) and Article 4(1) of EU Regulation 884/2014, (b) submit a health certificate in accordance with Regulation 7(1)(h) or Article 5 of EU Regulation 884/2014, (c) identify the consignment(s) with a code in accordance with Regulation 7(1)(i), or (d) ensure that the consignment is accompanied by a health certificate and the result of sampling and analysis in accordance with Regulation 7(1)(k) and Article 9(7) of EU Regulation 884/2014, is not guilty of an offence.”.
