Abstract
The Sea Pollution (Miscellaneous Provisions) Act 2006 is an Act that gives effect to the international convention on civil liability for bunker oil pollution damage and making provision for matters relating to council regulation (EC) no. 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters. Bunker oil means any hydrocarbon mineral oil (including lubricating oil) used or intended to be used for the operation or propulsion of a ship and any residues of such oil. The owner of vessels should take all the precautions not to disperse the oil.
In fact, the Act provides penalties for those who provoke pollution damages, which means loss or damage caused outside the ship by contamination resulting from the escape or discharge of bunker oil from the boat. The shipowner at the time of an incident will be liable for pollution damage caused by any bunker oil on board or originating from the ship, provided that, if an incident consists of a series of occurrences having the same origin, the liability will be off to the shipowner at the time of the first of such circumstances.
