Abstract
The primary objectives of this Law encompass ensuring the maintenance of a suitable environment, guided by the precautionary principle, to preempt and diminish environmental and health risks, enhance the overall quality of life and the environment, and safeguard the interests of the public and future generations. The Law's specific goals encompass: (i) enhancing the transparency of environmental information in Israel; (ii) incentivizing businesses to curtail emissions and the release of pollutants and waste into the environment; (iii) establishing an invaluable instrument for decision-making, research, and the formulation of a sustainable policy grounded in environmental equity. These objectives encompass (a) obligating factories to report emissions and the transfer of pollutants and waste from their facilities into the environment; (b) establishing a publicly accessible registry containing information on emissions and transfers of pollutants and waste from factories to the environment; (c) compiling an inventory encompassing data on pollutants and waste discharged or transferred from diverse sources into the environment.
Chapter II deals with the reporting duties, and establishes, among other things, that the owner of a plant shall deliver to the registrar, once a year, a report on the plant as detailed in Article 3. Under Article 6, the data che the plant's owner shall calculate regard (i) the amounts of polluting substances and waste that must be reported; (ii) plant's water consumption and energy consumption; (iii) quantities, concentrations and emission rate of polluting substances, sewage and waste. Furthermore, a registrar will maintain a register of emissions and transfers of polluting substances and transfers of waste. Chapter IV concerning the Penalties, establishes that the violations, listed in the Chapter, shall be punished according to the Penal Law, 1977-7737. Financial sanctions can be imposed for the violations listed in Chapter V.
