Abstract
This Act concerns the powers and participation of farmers' organizations in relation to the management of irrigation systems. This Act is divided into 7 Chapters: Preliminary (Chapter I); Farmers organization (II); Objects and functions of the farmers' organizations (III); Resources (IV); Offences and penalties (V); Settlement of disputes (VI) and Miscellaneous (VII).
The first Chapter consists of definitions and explanations of terms used within the Act. The Water Users Association is open to any person who is in lawful possession of the land under a water source (II). The Government may delineate areas of the irrigation system and declare them to be a distributory area. An Apex Committee is constituted under section 9 with the task of laying down policies for the implementation of the Act and giving directions to farmer's organizations in accordance with the provisions of the Act. The farmers' organizations primary aim is the promotion and secure distribution of water and maintenance of the irrigation system, efficient utilization of water to optimize agricultural production as well as the protection of the environment (sect. 16). Section 17 lists the functions of the Water Users Association whereas the functions of the distributory committee, including the preparation of an operational plan, are listed under section 18. The farmers organization funding and resources comprises several sources including government grants, fees collected by the farmers organization and income arising from the assets attached to the irrigation system (sect. 22). Chapter VII includes the requirement of relevant documents and records being retained by the farmers' organizations (sect. 28). The Chapter also includes provisions on resignations from farmers committees, the maintenance of a sinking fund, budget and power to give directions. The State government may, by notification in the Gazette, make rules for the purposes of implementing the Act (sect. 43).
