Abstract
This Act provides for management of soil and water conservation measures and land development in the state of Bihar. It consists of 7 Chapters: I. Preliminary; II. Notification of Area and Control over them; III. Constitution of the Board and the District Committees; IV. Preparation of Soil and Water Conservation and Land Development Plans; V. Execution of the Plan and Maintenance, Repairs and use of Work carried out under this Plan; VI. Penalty; VII. Miscellaneous.
Chapter I provides for the short title, extent, commencement and definitions. Chapter II empowers the state government to notify any area where it considers expedient to provide for conservation of soil and water or prevention or mitigation of erosion of lands. It also empowers the government to restrict or prohibit certain activities including clearing land, quarrying of stone, cutting of trees, admission of cattle, erection of buildings etc. in such notified areas. Chapter III allows the state government to constitute Bihar Soil and Water Conservation and Land Development Board to carry out the provisions of the Act and District Soil and Water Conservation and Land Development Committee to carry out functions mentioned in the Act. Chapter IV provides for matters which can be included in the plan such as prevention or mitigation of erosion of soil, improvement of soil, land levelling, reclamation of waste, saline or water-logged land, cultivation of fallow land, regulation of grazing, water supply etc. It also provides for the process of drawing up the plan and finalizing the same.
Chapter V provides for execution of the plan by the owners of the respective land or by the District Soil Conservation Officer, payment by land owners for work done, preparation of statement after completion of work and the maintenance and repair works. Chapter VI provides for penalty for any damage or obstruction to any work under the plan or any contravention of the provisions of the Act. Chapter VII provides procedure for enquiry and power to enter upon for survey, marking and others activities as mentioned in the Act. It also provides for appeal of orders made under certain provisions in the Act.
