Abstract
The Chhattisgarh Groundwater (Management And Regulation) Act, 2022 provides a new legal framework for sustainable management and regulation of ground water resources and equity in groundwater use. It consists of 30 sections across 6 Chapters: I. Preliminary; II. Institutional Framework; III. Duties and Responsibilities; IV. Powers and Functions; V. Violation, Offences and Penalties; VI. Miscellaneous.
The Act vide Chapter II, section 3 establishes the Chhattisgarh State Ground Water Management and Regulatory Authority. It further provides for the composition, powers and functions of the Authority. Chapter II also lays down the provision for setting up of District Ground Water Management Council at the district level and Block Level Ground Water User Registration Committee which will register all existing /new domestic and agriculture ground water users in the block. Chapter III requires the Water Resources Department to develop a mechanism to co-ordinate with the District Ground Water Management Council; collect and analyze ground water related data, publish reports; and identify and delineate over-exploited and critical blocks. Chapter IV mandates the registration of commercial, industrial, infrastructural and bulk users of Ground Water; bans construction of new wells; allows limiting abstraction of ground water, levying fees; and provides for impact assessment of social and environment aspects.
Chapter V requires registration of drilling agencies and provides for penalties for unlawful tubewell drilling, ground water abstraction and supply of raw unprocessed untreated ground water. Chapter VI provides for self-regulation by Ground Water users in notified areas including Rain Water Harvesting, Ground Water Recharge, Recycling and Reuse, Prevention of Water logging. It also requires all the receipts on account of penalties, registration fees, fee/levy on ground water abstraction, etc. to be credited to the Ground Water Conservation Fund.
