Abstract
These Rules amend the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 (principal Rules). In the principal Rules, after Chapter VI, a new Chapter VII titled Extended Producer Responsibility for Used Oil is added. This chapter contains definitions and requires registration of producers, collection agents, recyclers and used oil importers. No person shall carry out business without registration and any entity falling in more than one category must register in each such category separately. The extended producer responsibility covers managing used oil for producing re-refined base oil or lubrication oil, and energy recovery. All producers and used oil importers shall fulfil their extended producer responsibility obligation specified in the table under Rule 27.
The chapter also makes provisions for extended producer responsibility certificate generation and calculation method, and lays down responsibilities of producers, used oil importers, collection agents, recyclers, bulk generators, Central and State Pollution Control Boards, state governments, and municipalities or local bodies. The Central Pollution Control Board shall lay down guidelines for imposition and collection of environmental compensation on the producers in case of non-fulfilment of obligations set out in this Chapter, using false extended producer responsibility certificates, or on any entity on violation of any provisions of this Chapter and guidelines issued hereunder. A Steering Committee is formed to oversee the implementation of extended producer responsibility under this Chapter.
