Abstract
These Rules amend the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 (principal Rules). In Rule 9 of the principal Rules, sub-rule (4) is added, which states that the utilisation and management of waste tyre shall be in accordance to the provisions contained in Schedule IX. After Schedule VIII, a new Schedule IX titled Extended Producer Responsibility (EPR) for Waste Tyre is added.
This Schedule contains definitions and requires registration of producers, recyclers of waste tyre, and retreaders. No person shall carry out business without registration and any entity falling in more than one category must register in each such category separately. The extended producer responsibility obligations shall apply for manufacturers and importers of new tyres, waste tyre importers and retreaders as specified therein. The Schedule also contains provisions for extended producer responsibility certificate generation, calculation method, and transaction of such certificates. The responsibilities of producers and recylcers is laid down. The Central Pollution Control Board shall lay down guidelines for imposition and collection of environmental compensation on the producers in case of non-fulfilment of obligations set out in the Schedule and use of false extended producer responsibility certificates. A Steering Committee is formed to oversee the implementation of extended producer responsibility for waste tyre.
