Abstract
This Act is enacted to provide regulating provisions for the establishment of Panchayat Raj in State of Jharkhand.
The Act consists of 163 Sections divided into 17 Chapters: Short Title and Definitions(I); GRAM SABHA (II); Constitution of Panchayats (III); Conduct of Election (IV); Procedure of Transaction of Business and Meeting of Panchayats (V); Powers, functions and duties of officers of the Panchayat (VI); Functions of Panchayats (VII); Fund and Property of Panchayat (VIII); Establishment of Panchayats (IX); Taxation and Realisation of Claims (X) ; Control (XI) ; Penalty (XII); District Planning Committee (XIII); Rules and Bye-laws (XIV); Budget, Account and Audit (XV) ; Miscellaneous (XVI); Repeal and Savings (XVII).
Sectionn 11 provides for the constitution of Panchayats. For the purposes of this Act there shall be constituted - 1. Gram Panchayat for village, 2. Panchayat Samiti for a Block, and 3. Zila Parishad for a district. Sections 10.1 and 10.5 also talk about the powers of the Gram Sabhas in local decision-making and the implementation of schemes. Section 71, which mentions the seven different Standing Committees to be formed under the Gram Panchayat and Section 10.1, which discussed the powers and functions of the Gram Sabha, clearly mention that each Gram Sabha will have eight different Standing Committees including a village development committee. According to the Act, Gram Sabhas are supposed to have village development funds which include funds for grain, cash, commodity and labour and the Gram Sabha can receive funds through donations and incentives too.
Section 75 provides for the functions of Panchayats, which include functions in agriculture, animal husbandry, dairy and poultry, fisheries, social and farm forestry, drinking water facilities, poverty alleviation programme, etc.
