Abstract
This Act provides for the regulation and management of water resources in the state of Jharkhand. The Act consists of 25 sections over 5 Chapters: I. Preliminary; II. Establishment of Authority; III. Powers, Functions and Duties of the Authority; IV. Accounts, Audit and Reports; and V. Miscellaneous.
Chapter I provides for short title, commencement, extent and definitions. Chapter II establishes the Jharkhand Water Resources Regulatory Authority (‘Authority’), provides for composition of the Authority, selection of chairperson and members and other related provisions. Chapter III provides for powers, functions and duties of the Authority such as regulating distribution of water for irrigation, municipal/rural drinking water, industry etc.; fixing and regulating water tariff system and charges; promoting efficient use of water resources and minimizing wastage; etc. Chapter IV requires the Authority to prepare yearly financial budget, maintain accounts which shall be audited and publish an annual report. Chapter V provides for rules and regulations to be made pursuant to the Act and Dispute Resolution Officers to be appointed to resolve the disputes with regard to the issuance or delivery of water under the Act.
