Abstract
This Act provides for establishment of a water supply and drainage board in Karnataka and related provisions. It consists of nine chapters: I. Preliminary; II. Constitution of the Board; III. Officers and Members of the Staff of the Board; IV. Conduct and Business of the Board; V. Powers and Functions of the Board; VI. Investigation, Preparation and Execution, Maintenence etc. of Schemes by the Board; VII. Finance, Accounts and Audit; VIII. Penalties and Procedure; and IX. Miscellaneous.
Chapter I contains the short title, extent, commencement and definitions. Chapter II establishes the Karnataka Urban Water Supply and Drainage Board (Board) and provides for the constitution of the Board, appointment of its management including Chairman, the Managing Director and Directors. Chapter III allows the Board to appoint officer and member of the staff including a Secretary, a Chief Engineer and an Accounts Officer. Chapter IV makes provisions for the conduct and business of the board including meetings, appointment of committees and temporary hires. Chapter V lays down the powers and functions of the Board which primarily includes providing financial assistance by way of loans and advances to the local authorities for water supply and drainage for urban areas.
Chapter VI contains provisions relating to investigation, preparation and approval of schemes and execution thereof. It states that the supply of water for domestic purposes does not include supply for any trade, manufacture, business or for purposes of irrigation. The Act prohibits discharge of any trade effluent from any trade premises or liquids or matters prohibited from discharge into Board sewers. Chapter VII provides for fund of the Board, power of Board to borrow or lend and levy rates. It requires the Board to submit annual reports to the government and maintain accounts in the prescribed manner. Chapter VII provides for offences and penalties. Chapter VIII empowers the government to adjudicate disputes between the Board and local authorities and provides for compensation to be paid by offenders for damage caused. Chapter X allows the government to make Rules and the Board to make regulations in order to implement this Act.
