Abstract
Kerala Panchayat Raj Act is enacted to replace the enactments relating to Panchayats and district councils by a comprehensive enactment to establish a three-tier Panchayat Raj system in the State in line with the Constitution (Seventy-third Amendment) Act, 1992, for securing a great measure of participation of the people in planned development and in local Governmental affairs, by constituting Village, Block and District Panchayats; and endow such Panchayats with such powers and authority to enable them to function as institutions of self-Government.
The Act establishes a three-tier in the form of Grama Sabhas equated with the electoral constituency of a Village Panchayat. All the electors of the Ward are members of the Grama Sabha. The Grama Sabhas have been given clear rights and responsibilities with powers for identification of beneficiaries, strong advisory powers for prioritizing developmental needs and wide powers of social audit. The Act entrusts Panchayats the preparation of plans and implementation of schemes for economic development and social justice including the implementation of schemes in relation to the matters listed in the Eleventh Schedule to the Constitution. The Schedule 3, 4, 5 of the Act provide for the functions of Village Panchayats, Block Panchayats, and District Panchayats respectively. The mandatory funtions of Village Panchayats include: 1. Regulating building construction. 2. Protection of public lands against encroachment 3. Maintenance of traditional drinking water sources. 4. Preservation of ponds and other water tanks 5. Maintenance of waterways and canals under the control of Village Panchayats. 6. Collection and disposal of solid waste and regulation of liquid waste disposal. 7. Storm water drainage. 8. Maintenance of environmental hygiene. 9. Management of public markets. 10. Vector Control 11. Regulation of slaughtering of animals and sale of meat, fish and other easily perishable food stuffs etc. 12. Control of eating places. 13. Prevention of food adulteration. 14. Protection of roads and other public properties. 15. Street lighting and its maintenance. 16. Adopt immunisation programmes. 17. Effective implementation of National and State level strategies and programmes for prevention and control of diseases. The Schedule 3 also provides for the sector-wise functions of the Village Panchayats, covering: agriculture, animal Husbandry and diary farming, minor irrigation, fishing, social forestry, small scale industries, housing, water supply, electricity and energy, public health and sanitation, social welfare, poverty alleviation, tribe development, etc.
The Act further makes provisions for: delimitation of constituencies, constitution of Panchayats at different levels, finance and taxation, ombudsman for local self govenrment instiutions, offences and penalties, etc.
