Abstract
This Act provides for administration, management and operation of major ports in India. It consists of 76 sections across eight chapters: I. Preliminary; II. Board of Major Port Authority; III. Management and Administration; IV. Powers of Boards of Major Port Authorities in respect of Loans and Securities; V. Supervision of Central Government; VI. Constitution of Adjudicatory Board; VII. Penalties and VIII. Miscellaneous.
Chapter I provides for short title, commencement, application and definitions. It also lists the major ports to which the Act is applicable. Chapter II establishes the Board of Major Port Authority (Board) and contains provisions relating to the constitution, composition, meetings and committees thereof. Chapter III provides for management and administration related provisions including planning and development of the major ports, imposition of rates, lien etc. Chapter IV lays down the powers and functions of the Board relating to finance such as power to raise loans and issue securities, establishing sinking fund, application of money in general accounts, preparing budget, maintaining accounts and annual statements.
Chapter V contains provisions for supervision by central government including submission of reports by the Board, survey of works of Board, taking over management of the Board, or issuing directions to the Board. Chapter VI constitutes the Adjudicatory Board with such powers and functions as mentioned in the Act including tariff setting, adjudication of disputes, providing measures to revive stressed PPP projects, review and appeal. Chapter VII provides for offences and penalties. Chapter VIII provides for CSR, power of government to make rules and power of Board to make regulations.
