Abstract
This Act provides for development and management of marine aids to navigation in India. It consists of 52 sections over 14 chapters: I. Preliminary; II. Designation of General Aid to Navigation; III. Director General of Aids to Navigation; IV. Management of General Aids to Navigation; V. Management of Vessel Traffic Services; VI. Inspection and Management of Local Aids to Navigation; VII. Obstruction to functioning of Aids to Navigation; VIII. Training and Certification; IX. Marking of Wrecks; X. Development of Heritage Lighthouses; XI. Marine Aids to Navigation Dues; XII. Finance, Accounts and Audit; XIII. Offences and Penalties; and XIV. Miscellaneous.
Chapter I contains the short title, extent, commencement and definitions. Chapter II empowers the central government to designate any aid to navigation to be a general aid to navigation. Chapter III provides for appointment of Director General, Deputy Director Generals and Directors for districts of aids to navigation. A Central Advisory Committee (Committee) shall be appointed for consultation in respect of aids of navigation. Chapters IV and V state the powers of central government relating to aids to navigation and management of vessel traffic services respectively. Chapter VI provides for inspection, control and management of local aids to navigation. Chapter VII allows the central government to specify restrictions on activities that interfere with or obstruct the operation of any aid to navigation.
Chapter VIII requires obtaining a valid training certificate to be allowed to operate or work on any aid to navigation. Chapter IX provides for marking of wrecks. Chapter X provides for designation of any aid to navigation under government control to be a heritage lighthouse which shall be developed for educational, cultural and tourism purposes. Chapter XI contains provisions relating to levy, collection and utilisation of marine aids to navigation dues and related aspects. Chapter XII requires maintaining a separate account for amounts receivable under the Act and an annual financial statement to be laid before the Committee. Chapter XIII provides for offences and penalties and Chapter XIV permits the central government to make rules, delegate its powers and functions and issue directions to the Director General.
