Abstract
This Act provides for the establishment of the New Delhi Municipal Council and for matters connected therewith or incidental thereto. The Act consists of 419 Sections divided into 23 Chapters: Preliminary; The Council; Functions Of The Council; The Chairperson; Procedure; Municipal Officers And Other Municipal Employees; Revenue And Expenditure; Taxation; Borrowing; Property And Contracts; Water Supply, Drainage And Sewage Collection; Electricity Supply; Streets; Building Regulations; Sanitation And Public Health; Vital Statistics; Public Safety And Suppression Of Nuisances; Markets, Trades And Occupations; Improvement; Powers, Procedure, Offences And Penalties; Rules, Regulations And Bye-Laws; Miscellaneous.
There shall be a Council charged with the municipal government of New Delhi, to be known as the New Delhi Municipal Council. The functions of the Council include: (a) the construction, maintenance and cleansing of drains and drainage works and of public latrines, urinals and similar conveniences; (b) the construction and maintenance of works and means for providing supply of water for public and private purposes; (c) the scavenging, removal and disposal of filth, rubbish and other obnoxious or polluted matters; (d) the construction or purchase, maintenance, extension, management for supply and distribution of electricity to the public; etc.
Chapter 11 defines the functions of the Council in relation to water supply, drainage and sewage collection, which include ascertaining the sufficiency and wholesomeness of water supplies within New Delhi and receiving bulk supplies of water from the authority prescribed by the Central Government; control of drains and sewage collection works; etc. The Chairperson may permit the owner, lessee or occupier of any premises to connect the premises by means of supply pipes for conveying to the premises a supply of water for his domestic purposes from the municipal water works subject to the requirements specified in section 159 and the conditions. All municipal drains, all sewage collection and all works, materials and things appertaining thereto shall be under the control of the Chairperson.
