Abstract
This Act provides for regulation and maintenance of canals and drainage works in the state of Punjab. It consists of eleven Parts: I. Preliminary; II. Of the Application of Water For Public Purposes; III. Of the Construction and Maintenance of Works; IV. The Supply of Water; V. Water Rates; VI Canal Navigation; VII. Drainage; VIII. Jurisdiction; IX. Formation of Water User Association; X. Offences and Penalties; and XI. Subsidiary Rules.
Part I contains the short title, extent, commencement and definitions. Part II provides for utilization of water of river, stream, lake etc. for any existing or projected canal or drainage work for public purpose. Part III makes provisions in respect of construction of water course, power of canal officer to enter any land for survey or repairs, regulating water supply, and payment of compensation to land owners for damage. The procedure for preparation of draft scheme for construction, alteration etc. of waterworks and its publication ad implementation is laid down. Part IV provides for use of canal water for purposes other than irrigation. The Divisional Canal Officer is given the powers to stop supply of water to any watercourse in certain cases. Part V contains provisions relating to the liability for paying charges in case of use of water from canal, waste of water, water supply to cantonments, towns, industry, bulk supply etc., and for irrigation. The dues may be recovered as arrears of land revenue.
Part VI provides for regulation on navigation by vessels in any canal. The provisions for recovery of fines for offences committed, seizure of vessel and cargo or goods are laid down. Part VII makes provisions in respect of obstruction of any river, stream or drainage-channel, field drains and preparation of schemes for works of improvement. Part VIII lays down the powers of deputy collector to pass orders regarding the distribution of water from a watercourse amongst persons of any estate or group of estate and settle disputes between such persons. Part IX provides for formation of water user associations for preparing water conservation plans and promoting efficient use of water, resolution of disputes, collection of cess and other matters. Part X lays down the offences and penalties and Part XI gives power to state government to make rules for carrying out all or any of the purposes of the Act.
