Abstract
The Punjab Water Regulation and Development Authority (Authority) has issued these Directions in exercise of powers conferred under Section 15 (2) of the Punjab Water Resources (Management and Regulation) Act, 2020. It consists of nine chapters: 1. Preliminary; 2. Ground Water Conservation; 3. Permission for Groundwater Extraction; 4. Groundwater Charges; 5. Monitoring of Groundwater Extraction; 6. Non-Compliance Charges; 7. Water Audit; 8. Ad-Interim Permissions; and 9. Petitions to Authority and Removal of Difficulties.
Chapter 1 contains the short title, commencement, extent and definitions. Chapter 2 states that the main objective of the Directions is to improve the water balance by promoting and ensuring conservation of water by the Users. It provides for measures for ground water conservation including private and public water conservation schemes, rain water harvesting and reuse of treated waste water. Chapter 3 consists of directions relating to permission for groundwater extraction including applications for permission, time period for making application for existing units and new units, processing of applications, permission for water tankers and drilling rig. It also provides for renewal, suspension and cancellation of permission. Chapter 4 lays down the groundwater charges and application fees for various applications. It also provides for water conservation credits for the water conserved by a Unit under a scheme approved by the Authority.
Chapter 5 contains directions for monitoring groundwater extraction through metering and measurement of groundwater levels. Chapter 6 provides for the charges for failure by a User to comply with provisions of the Directions and for inspection for purpose of checking, determining or monitoring the compliance of the Directions. Chapter 7 relates to water audit and consists of objectives of water audit, the activities to be carried out and the composition of the water audit report. Chapter 8 contains direction in respect of ad-interim permission obtained under the draft guidelines. Chapter 9 provides for filing petitions to the Authority pursuant to an Order under the Directions and empowers the Authority to remove difficulties in giving effect to any of the provisions of the Directions.
