Abstract
This Act provides for the regulation and development of drinking water and sewerage in the state of Punjab. The Act consists of 72 sections over 11 Chapters: I. Preliminary; II. Establishment and Incorporation of Board; III. Officers and Employees of the Board; IV. Conduct of Business of the Board; V. Powers and function of the Board; VI. Investigation, Preparation and Execution of Schemes by the Board; VII. Transfer of Assets and Liabilities of the Department of Public Health; VIII. Finance, Accounts and Audit; IX. Penalties and Procedure, X. Miscellaneous; and XI. Rules and Regulations.
Chapter I contains the short title, extent, commencement and definitions. Chapter II provides for the establishment of the Punjab Water Supply and Sewerage Board (Board), the composition of the Board headed by a Chairman and their term of office and conditions of service. Chapter III provides for the appointment of officers and employees of Board, regulation for their recruitment and service, provident fund for the employees and related provisions. Chapter IV lays down the procedure of conduct of business of the Board including meetings and appointment of committees to discharge its functions. Chapter V provides for the powers and functions of the Board such as investigation, survey, planning and preparation of schemes, execution of the schemes etc. Chapter VI empowers the Board to investigate the nature and type of a scheme for providing Water Supply and sewerage facilities and prepare the same for approval of the government. It also provides for publishing of the approved scheme and its execution thereafter.
Chapter VII transfers the assets and liabilities of the Department of Public Health to the Board including its property, employees, provident fund and pension contributions. Chapter VIII states that the Board shall have a fund and the government may make grants or advance loans to the Board. The Board can acquire loans for which the government may provide guarantees. The account of the Board shall be audited and the Board has to present reports to the government. Chapter IX provides for penalties and procedure for trial by courts. Chapter X provides for special and emergency powers to Managing Director, adjudication of disputes between the Board and local authorities, compensation and other powers to the Board. Chapter XI empowers the government to make rules and regulations for carrying out the purposes of this Act.
